1. Agreement to these Terms
Welcome to FORE SEASONS GOLF STUDIO. These Terms of Service (the "Terms") are a binding agreement between you and FORE SEASONS GOLF STUDIO, LLC, a New Jersey limited liability company ("FORE SEASONS," "we," "us," or "our"). They govern your current use of our website at foreseasonsgolfstudio.com (the "Website") and, once separately offered, reservation, membership, facility, booking, and access services (together, the "Services").
By using the Website, you agree to these Terms for that use. A prior paid reservation is governed as described in Section 5, and any future paid Service will require the agreement presented for that Service. If you do not agree, please do not use the Services.
Please also read our Privacy Policy, which explains how we handle your information and is incorporated into these Terms by reference.
2. Who we are
FORE SEASONS GOLF STUDIO is an indoor golf simulator studio being developed in Forked River, Ocean County, New Jersey, and is owned and operated by FORE SEASONS GOLF STUDIO, LLC. We are currently in a pre-launch phase. Opening timing will be announced when approved. Some parts of these Terms describe Services that are not yet available and will apply once the studio opens.

3. What these Terms cover, and other agreements
These Terms cover your general relationship with us. Some Services are governed by additional, more specific agreements that you will review and accept at the appropriate time. Where an additional agreement applies, it controls over these Terms for that Service if there is any conflict. Those agreements include:
- the Reservation Terms presented to a customer who previously completed a paid Founding reservation (see Section 5);
- the FORE SEASONS Membership Agreement, which governs the purchase, billing, renewal, and cancellation of a membership; and
- the FORE SEASONS Liability Waiver and Release, which governs your use of the facility and equipment.

4. Who may use the Services
You must be at least 18 years old to enter a paid reservation or membership transaction, make a payment, or enter into any agreement with us. If such a Service is offered and you use it, you confirm that you are at least 18 and able to enter into a binding contract. New paid Founding reservations are not currently available.
Minor registration and attendance are not currently available. If a future minor program is approved, a minor of any age may attend only through the approved parent/legal-guardian process, with the minor’s own parent or legal guardian on site and directly supervising for the entire session. The possible school/coach exception is not available.
5. Prior Founding reservation support; new paid reservations paused
New paid Founding reservations are not currently available. Nothing on the Website currently offers or reserves a membership, spot, queue position, rate, quantity, or opening time. Joining the free opening-update list is not a reservation and requires no payment.
If you previously completed a paid reservation, your payment-processor receipt, the Reservation Terms presented when you paid, and applicable law govern that transaction. This revised Website does not replace those terms or reduce any existing right.
- Keep your records. Retain your receipt, transaction identifier, and the Reservation Terms shown at payment.
- Get support. Email info@foreseasonsgolfstudio.com from the address used for payment and include the name and transaction identifier on the receipt to request a copy, status review, or refund support.
- No new promise here. This Section does not state or change any prior customer's payment amount, queue position, refund right, offer priority, rate, or timing. Those issues must be determined from that customer's existing transaction record and applicable law.
6. Memberships, billing, and taxes
When the studio opens, memberships will be sold under the FORE SEASONS Membership Agreement. That agreement is the controlling document for membership pricing, included hours, contract length, automatic renewal, cancellation, early-termination charges, and any behavioral or service fees. Current membership tiers and prices are shown on the Website and stated in full in the Membership Agreement. Please read the Membership Agreement carefully before you join.
A few points apply to all paid Services:
- Automatic renewal. Memberships are sold as fixed-term agreements that renew automatically unless cancelled within the window described in the Membership Agreement. Before you join, the Membership Agreement will disclose the renewal terms and how to cancel.
- New-membership cancellation. No membership is currently for sale. Before any sale, the Membership Agreement will state the applicable statutory rights and FORE SEASONS' cancellation promise. We currently intend to allow cancellation before midnight of the third operating day after receipt of the contract for a full refund, while New Jersey counsel and the Division of Consumer Affairs classification are finalized.
- How we bill. Recurring monthly dues are charged by automatic bank debit (Automated Clearing House, or "ACH"). One-time charges, such as guest fees, events, or tournaments, may be charged to a card on file or by bank debit. We use a third-party payment processor (see Section 11); we do not store your full card or bank-account numbers ourselves.
- Disputes and reversals. Before we draft a disputed fee, we provide a short dispute window, as described in the Membership Agreement, so you can raise a question first.
- Taxes. No paid Service is currently offered on this Website. A future checkout will disclose and collect applicable tax only after the taxable service/category and rate have been verified.
7. Facility access and the 24/7 unmanned model
Our studio is designed to operate 24 hours a day, seven days a week, without on-site staff during normal member hours. Members book a bay through our application and receive a unique, time-limited entry code in the app for the reserved session. The following rules apply once the facility is open:
- Your access credentials and bookings are personal to you. Do not share them, prop open or disable any door, or let anyone enter who is not part of your booked session and covered by a current waiver.
- You are responsible for everyone you admit to the facility during your session, including guests, and for their conduct and safety.
- The facility is monitored by video-only security cameras for safety, security, and service purposes, as described in our Privacy Policy. The studio does not record audio.
- If you encounter an emergency, a safety hazard, equipment damage, or a maintenance issue, contact us promptly using the methods we provide and follow any posted emergency instructions.
We may suspend or limit access where needed to protect members, staff, the public, or the facility, or to perform maintenance.
8. Facility rules and conduct
To keep the studio safe, clean, and enjoyable for everyone, you agree to follow these rules and any additional rules we post or include in the Membership Agreement:
- No alcohol. Alcohol is not permitted on the premises. The studio is a dry facility.
- Food and drink. Food is allowed only in the lobby or common area, not in the simulator bays. Beverages must be in spill-proof containers.
- Guests. No more than three guests are allowed per ordinary session, and every adult guest must complete the then-approved registration/readiness process before entry. Guest registration and guest-bearing access are currently paused. Minor registration and attendance are not currently available; any future program will require the minor’s own parent or legal guardian on site and directly supervising throughout, and a minor will never receive an access credential.
- Care of the space and equipment. Use the bays, simulators, screens, turf, and other equipment only as intended, and leave the bay in the condition you found it. Charges for damage or for leaving a bay in poor condition are described in the Membership Agreement.
- Respectful, lawful use. Do not engage in unsafe, illegal, threatening, or disruptive behavior, and do not use the facility for any purpose other than its intended recreational use.
We may refuse, suspend, or terminate access for conduct that violates these rules or that we reasonably believe threatens safety, the facility, or other members.
9. Assumption of risk; Liability Waiver
Golf, including indoor simulator golf, is a physical activity that involves swinging clubs and striking balls at speed and carries an inherent risk of injury to you and others and of damage to property. You understand and voluntarily accept these risks when you use the facility.
Before any future facility use, each adult participant will be required to review and accept the then-approved adult participation agreement; any approved minor path will use its separate parent/legal-guardian process. No such production signing flow is currently released. The specific agreement will control facility participation, and nothing in these Terms limits a right that cannot be limited under New Jersey law.
10. Acceptable use of the Website
You agree to use the Website only for lawful purposes and not to:
- interfere with, disrupt, or attempt to gain unauthorized access to the Website, our systems, or other users' data;
- copy, scrape, harvest, or collect information from the Website by automated means without our written permission; or
- use the Website to transmit anything unlawful, harmful, or infringing.
11. Payments and third-party services
Third parties support parts of the Website and any approved future Services, including hosting, authentication/storage, payments, bank verification, and communications. Their terms and privacy policies may apply to the service they provide. FORE SEASONS remains responsible for its own promises and duties and does not disclaim them merely because a provider is used. External links are provided for convenience and are not an endorsement.
12. Intellectual property
The FORE SEASONS GOLF STUDIO name and logo are trademarks of FORE SEASONS GOLF STUDIO, LLC. The Website and its content — including text, graphics, layout, and design — are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-exclusive, revocable license to view and use the Website for its intended purpose. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission, except as allowed by law.
13. Disclaimers
The free pre-launch Website is provided on an "as is" and "as available" basis to the extent permitted by law. We do not promise uninterrupted or error-free availability. This paragraph does not disclaim a specific paid-transaction promise, reasonable security obligation, or right that cannot lawfully be disclaimed.
Because we are in a pre-launch phase, information on the Website about the studio — including any target opening date, location, equipment, pricing, and features — is subject to change and is not a guarantee. Rights arising from a prior paid reservation are governed as described in Section 5 and are not reduced by this paragraph.
14. Limitation of liability
These interim pre-launch Website Terms do not establish a monetary liability cap for a paid transaction or facility use. Any future limitation will appear conspicuously in the counsel-approved agreement for that service and will not limit fraud, gross negligence, reckless or willful misconduct, statutory duties, data/security duties, or another right that New Jersey law does not permit us to limit.
15. Indemnification
These interim pre-launch Website Terms do not impose an indemnity. Any indemnification obligation for a future paid or facility service will exist only if stated in the specific counsel-approved agreement presented for that service. This Website summary does not create, expand, or alter such an obligation.
Text messaging (SMS) program
Transactional texts, such as an account, booking, door-access, lesson, or one-time verification message for a service you request, are separate from marketing consent. If you separately check the marketing-consent box, you agree to receive recurring automated marketing text messages from FORE Seasons Golf Studio about opening updates, membership-sale announcements, studio news, and occasional offers. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help, or contact info@foreseasonsgolfstudio.com. Consent to marketing texts is not a condition of any purchase. Mobile information is never sold or shared with third parties for their own marketing. Carriers are not liable for delayed or undelivered messages.
16. Changes to these Terms
We may update these Terms prospectively and will change the "Last updated" date. A Website edit does not retroactively change a prior payment, fixed-term agreement, release, renewal choice, payment authorization, or sensitive-data consent. We will provide notice and obtain renewed assent where required.
17. Suspension and termination
You may stop using the Website at any time. We may proportionately restrict access for security, unlawful use, or material violation, subject to applicable notice and review. Terms that by their nature must survive, including intellectual-property ownership and governing law, continue only to the lawful extent.
18. Governing law and venue
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Website that is not resolved informally will be brought exclusively in the state or federal courts located in or serving Ocean County, New Jersey, and you consent to the jurisdiction of those courts. Nothing in this section waives any consumer right or remedy available to you under New Jersey law.

19. General
These Terms, together with the Privacy Policy and any agreement referenced in Section 3, are the entire agreement between you and us about the Website. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a sale or reorganization of the business. We are not liable for delays or failures caused by events beyond our reasonable control.
